It depends on what kind of bankruptcy you filed for previously and how long it has been since you filed. If you received a discharge previously under Chapter 7, you must wait eight years from the date you filed previously before you may file again under Chapter 7. Alternatively, you must wait four years before you may file under Chapter 13. If you received a discharge previously under Chapter 13, you must wait two years to file again under Chapter 13 or six years to file under Chapter 7.
